The 2018 CFTC account ties a $3 million penalty to specific historical contracts and access-control failures. Product naming did not replace a legal perimeter.
What the primary record establishes
On 19 July 2018, the CFTC announced a $3 million civil monetary penalty against Intrade The Prediction Market Ltd. and Trade Exchange Network Ltd. The release explains that it followed an earlier summary judgment and a later decision on the penalty. CFTC — Release 7758-18, 19 July 2018 ↗
The court record described by the CFTC covered 5,503 binary option contracts involving regulated commodities traded by US customers between September 2007 and 25 June 2012. The release also describes violations by TEN of a 2005 cease-and-desist order, including inadequate or removed access blocks. CFTC — Release 7758-18, 19 July 2018 ↗
What the distinction changes
The significance is narrower than a claim that every prediction market is unlawful. The case involved particular entities, contracts, customers, dates and an existing order. It demonstrates why a product’s marketing category cannot alone establish the permissions governing its distribution.
An access-control policy must also be distinguished from evidence that the control actually operated. A statement excluding a jurisdiction does not prove that affected accounts, contract lists and account changes were consistently restricted in practice.
What to check before drawing a conclusion
For a historical timeline, separate the 2012 complaint, the 2015 liability decision and the 2018 penalty announcement. A later article publication date does not turn an old court finding into a new regulatory rule or a current ruling on another venue.
For any present offering, identify the contracting entity, contract characteristics and applicable jurisdiction before drawing conclusions. WFN uses this record to explain evidentiary scope and implementation; it does not decide the legal status of an unidentified contemporary product.
