The Central Bank's announcement explains the move from temporary ESMA intervention to national measures intended to continue retail protection. It identifies concerns arising from binary options' predetermined outcomes and speculative use. The announcement supplies the policy background; the detailed operative measure supplies the conditions that need to be applied to a particular product. Central Bank of Ireland: announcement of national binary-options and CFD measures WFN analysis: a claim that an option becomes permissible after three months omits two essential documentary and economic conditions. The relevant question is not just the displayed expiry date, but whether the prospectus and provider-risk arrangements meet the measure's wording. Those arrangements cannot be established by a marketing label. The separate capital-preserving exclusion likewise needs a complete cost comparison. A headline payout equal to the initial stake may not answer whether commissions and other charges are covered. Product terms and the customer's total payment are the relevant evidence, rather than a promised percentage return.

The exclusions have different tests
Part B prohibits retail marketing, distribution and sale in or from Ireland. One exclusion concerns contracts whose lower fixed payout covers the customer's total payment, including charges. Another requires all three conditions: at least 90 calendar days from issuance to maturity, a publicly available approved prospectus, and no provider market risk or trading profit or loss beyond previously disclosed charges. The latter is a cumulative test, not a duration-only permission. Central Bank of Ireland: Binary Options Intervention Measure, Part B
The Central Bank lists binary-options prohibition and CFD restrictions as separate national measures, with different application dates. A rule restricting leverage for CFDs should therefore not be used to describe whether a binary option is within the Irish measure. Product classification has to come before importing requirements from another category. Central Bank of Ireland: current MiFID requirements and national product measures
